Individuals with Trust, Estate and Gift Matters

Think trust, estate and gift taxes don’t apply to you? You may be surprised! Below is a very brief and potential set of circumstances that may leave you exposed to tax reporting requirements. These examples only include a very small portion of circumstances that may require trust, estate and gift tax reporting. Note that not all reporting requires paying actual taxes; however, filing the tax returns may still be required.

  • Setting up and funding an irrevocable trust with money or other assets such as real estate, life insurance policies, collectibles, etc. An irrevocable trust is typically used to manage your assets after your death so that your beneficiaries receive what you want them to receive and when you want them to receive them, whether it’s the income from the assets or the assets themselves.
  • Funding a college savings fund for anyone (including your children or grandchildren) in an amount that is more than the gift tax annual exclusion. The exclusion is $17,000 for gifts made in 2023 and will increase to $18,000 for gifts made in 2024.
  • Gifting an ownership interest in your company to someone (including your children or grandchildren).
  • Forgiving a debt or lending money with no interest or at a reduced interest rate.
  • When an individual passes away, the personal representative of the estate may be required to file an estate tax return for any income that the decedent’s assets earn during the time between the date of death and the time that the assets are distributed to the beneficiary.

Questions you should ask yourself to determine if you may be subject to trust, estate and gift tax reporting include (but not limited to):

  • Did I set up a trust?
  • Was I appointed as a trustee of a trust?
  • Did I transfer something I own to another person for less than what I received in return?
  • Am I the court appointed personal representative of an estate?

At USC she was a member of Beta Alpha Psi, an international honor society for accounting, finance and information systems. She sat for the CPA exam in November 1997 and passed all four parts in her first attempt. Heather has worked in the private sector doing bookkeeping and financial statement reporting for eight years, beginning in high school, through college, then continuing on until becoming a Certified Public Accountant. She has been in public accounting since 1997.
